Privacy Policy

1      About this Privacy Policy

Nicky Clarke is operated by G2S Limited (we, us, G2S). This Privacy Policy is designed to give you information as to how we obtain and process personal data relating to you, for example when you purchase a product or service from us, sign up to our newsletter, or take part in a competition.

We will process your personal data as a “data controller” or “controller”. This means that we have responsibility for deciding how we hold and use personal data relating to you. We are committed to protecting and respecting your privacy.

Please read this Privacy Policy carefully (together with our Cookies Policy and Terms and Conditions. From time to time we may also issue other privacy or fair processing notices to you relating to the way in which we collect personal data about you which we will bring to your attention.

Our site is not intended for children and we do not knowingly collect data relating to children.

2      Who we are and how to contact us

Our site is operated by G2S Limited. G2S Limited is a limited company registered in England and Wales under company number 6938838 and has its registered address at Green Bank Business Park, Swan Lane, Hindley Green, Wigan.

3      The data we collect and process about you

Personal data, or personal information, means any information about an individual from which that person can be identified. It does not include data where the identity has been removed (anonymous data).

We may collect, use, store and transfer the following kinds of personal data about you which we have grouped together as follows:

  • Identity Data- name, title, date of birth and username.
    • Contact Data - your contact details, including billing address, delivery address, email address and telephone numbers.
    • Transaction Data - details of your order, details about payments to and from you, correspondence or communications with you in respect of your orders, and details of products in respect of which you have registered for a warranty and details of such warranty cover.
    • Technical Data - details of the device(s) you use to access our services, your internet protocol (IP) address, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform and other technology on the devices you use to access our site.
    • Profile Data - your preferences, and feedback.
    • Usage Data - information as to how and when you use our site, including how you navigate our site and if you encounter any problems.
    • Marketing and Communications Data - your preferences in receiving marketing and communications from us and third parties.

You may also provide to our third-party payment provider (currently Sage Pay) payment data (such as payment card details) when you purchase products or services through our site. Such information is processed by our payment provider and not stored by us.

We may also collect, use and share aggregated data such as statistical or demographic data for any purpose. Aggregated data may be derived from your personal data but is not considered personal data as this data does not directly or indirectly reveal your identity. For example, we may aggregate your Usage Data to calculate the percentage of users accessing a specific feature of our site. However, if we combine or connect aggregated data with your personal data so that it can directly or indirectly identify you we treat the combined data as personal data which will be used in accordance with this privacy policy.

4      How we collect personal data


  • Direct interactions

You may give us your Identity, Contact and Marketing and Communications Data (as described above) when you fill in a form on our site, or when you correspond with us by post, phone, email, telephone or otherwise.

This includes personal data you provide when you:

  • create an account on our site;
  • order products or services;
  • make an enquiry or report a problem;
  • register for a product warranty;
  • subscribe to receive marketing communications;
  • connect with us, follow us or “like” us on social media;
  • provide feedback to us.


  • Automated technologies or interactions

When you interact with our site, our systems will automatically collect Technical and Usage Data about your equipment, browsing actions and patterns. We collect this personal data by using cookies server logs and other similar technologies. Please see our Cookies Policy and section 9 below for further details.

  • Third parties

We may also receive personal data about you from various third parties as set out below:

  • Technical Data from analytics providers such as Google Analytics;


  • Identity, Contact and Transaction Data from payment service providers such as Sage Pay.


5      How and why we use your personal data

We will only use your personal data when we have a legal basis to do so. Most commonly, we will use your personal data in the following circumstances:

  • Where we have your consent to do so;


  • Where it is necessary for the performance of a contract to which you are a party or to take steps at your request before entering into such a contract;


  • Where it is necessary for our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests; or


  • Where it is necessary to comply with a legal or regulatory obligation that we are subject to.

We have set out in the table below a description of the ways we plan to use your personal data, and the legal bases we rely on to do so. We have also identified what our legitimate interests are where appropriate.

Note that we may process your personal data for more than one lawful ground depending on the specific purpose for which we are using your data.

6      Marketing

Marketing communications from us: We may send you marketing communications if:

  • we acquired your contact details in the course of a sale of our products or services and you have not opted out of receiving marketing communications from us; or
  • you have consented to receive marketing communications from us.

Third party marketing: We will only share your personal data with another company for marketing purposes if you have expressly consented to us doing so.

Opting out: You can ask us and/or third parties to stop sending you marketing communications at any time by:

  • clicking on the unsubscribe button in the footer of any marketing email;
  • contacting our helpdesk on 0345 209 7461.


7      Change of purpose

We will only use your personal data for the purposes for which we collected it, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose. If we wish to use your personal data for an unrelated purpose, we will notify you and we will explain the legal basis which allows us to do so.

We may process your personal data without your knowledge or consent, in compliance with the above rules, where this is required or permitted by law.

8      If you fail to provide personal data

Where we need to collect personal data from you in order to comply with our legal obligations or to perform a contract we have with you and you fail to provide that data when requested, we may not be able to perform the relevant contract (for example, to supply products or services to you). In this case, we may have to cancel the relevant contract.

10   Who we disclose personal data to

We may share or disclose personal data with the third parties set out below:

  • to business partners, suppliers, sub-contractors and other third parties that we use in connection with the running of our business for the purposes set out in the table above in section 5 (‘How and why we use your personal data’), such as:
    • third party service providers that we engage to provide IT systems and software, and to host our website;
    • third party payment providers to process your payment to us. Your payment details are provided to the third-party payment provider; we do not store your payment information;
    • third party service providers that we engage to deliver goods you have ordered or collect goods from you;
    • third party service providers that we engage to send emails and postal mail on our behalf;
    • analytics and search engine providers that assist us in the improvement and optimisation of our website;
    • our group company, Product Care Limited, which provides after care services and may provide delivery services to our customers.

We may also disclose personal data:

  • to group companies, in the context of a business reorganisation or group restructuring exercise;
    • to our professional advisers including lawyers, bankers, auditors and insurers for the purpose of providing consultancy, banking, legal, insurance and accounting services to us;


  • to HM Revenue & Customs, who require reporting of processing activities in certain circumstances;


  • if we are under a duty to disclose or share your personal data in order to comply with any legal obligation;


  • to third parties to whom we may choose to sell, transfer or merge parts of our business or our assets. Alternatively, we may seek to acquire other businesses or merge with them. If a change happens to our business, then the new owners may use your personal data in the same way as set out in this privacy policy.

We require all our data processors to respect the security of your personal data and to treat it in accordance with the law. We do not allow our data processors to use your personal data for their own purposes and only permit them to process your personal data for specified purposes and in accordance with our instructions.

11   International transfers

We do not transfer any personal data outside of the EEA.

12   Data security

We have put in place appropriate security measures to prevent your personal information from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. In addition, we limit access to your personal information to those employees, agents’ contractors and other third parties who have a business need-to-know, and will require third parties who process personal data on our behalf to process your personal information on our instructions.

We have put in place procedures to deal with any suspected data security breach and will notify you and any applicable regulator of a suspected breach where we are legally required to do so.

13   Data retention

We will only retain your personal data for as long as necessary to fulfil the purposes we collected it for.

14   Your rights in respect of your personal data

Under the European General Data Protection Regulation (the GDPR), you have the following rights, in certain circumstances, in respect of the personal data that we process about you:

  • the right to request access to your personal data that we hold and to receive certain information relating to that data (commonly known as a “data subject access request”);


  • the right to ask us to rectify inaccurate data or to complete incomplete data (though we may need to verify the accuracy of the new data you provide to us);


  • a right to receive or ask for your personal data to be transferred to a third party in a structured, commonly used and machine-readable format (note that this right only applies to automated information which you initially provided consent for us to use or where we used the information to perform a contract with you);


  • the right to request the erasure of personal data where there is no good reason for us continuing to process it (note, however, that we may not always be able to comply with your request of erasure for specific legal reasons which will be notified to you, if applicable, at the time of your request);


  • the right to object to how we process your personal data in certain circumstances, including the right to ask us not to process your personal data for marketing purposes;


  • the right to restrict processing of your personal data, for example if you want us to establish the accuracy of the data, or you have objected to our use of your data but we need to verify whether we have overriding legitimate grounds to use it;


  • where we are processing personal data relating to you on the basis that we have your consent to do so, you may withdraw your consent at any time (this will not affect the lawfulness of any processing carried out before you withdraw your consent). If you withdraw your consent, we may not be able to provide certain products or services to you.

If you wish to exercise any of the rights set out above in respect of your personal data, please contact us using the contact details set out in section 16 below (‘Contact us’).

We may ask you to verify your identity if you make a request to us to exercise any of the rights set out above. This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request.

You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we may refuse to comply with your request in these circumstances.

We will try to respond to all legitimate requests within one month. Occasionally, it may take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.

You have the right to make a complaint at any time to the Information Commissioner's Office (ICO), the UK supervisory authority for data protection issues ( We would, however, appreciate the chance to deal with your concerns before you approach the ICO, so please do contact us in the first instance and we shall endeavour to resolve your complaint.

15   Your duty to inform us of changes

It is important that the personal data we hold about you is accurate and current. Please keep us informed if your personal data changes during your relationship with us.
